PJLHOSTING.COM TERMS OF SERVICE FOR WEB HOSTING AND SERVICES

General
Subscribers to our service must be at least 18 years of age or have the approval of the minor's legal guardian.  By subscribing to our services, you agree to our Terms of Service ("TOS").  The TOS stipulated here supersedes any oral or written agreements.  We reserve the right to close any account at any time, for any or no reason.  We reserve the right to amend the TOS at any time without prior notice.  Subscribers have the right to terminate services and disassociate with PJLHosting.com.

Christian Faith
PJLHosting.com is run by Christians.  As such, PJLHosting.com seeks to glorify and honor God through its services.  While recognizing that Christian unity does not require uniformity, we unapologetically stand by the essentials of the Christian faith.  These are defined for you in our Statement of Faith.  We will not host websites that mock or contradict the Christian faith.  Non-ministry websites such as business or personal sites are permitted as long as they meet this standard.

Inappropriate Use of Service
In accord with the restrictions mentioned in the preceding paragraph, we wish to clarify some specific areas of concern.  PJLHosting.com does not permit illegal, pornographic, or harmful sites.  "Unsolicited Commercial Email" and spam is not permitted.

• Illegal material is not permitted.  This involves anything that is in violation of Federal, State, or local regulations and laws.  For example, we do not permit the sending or posting of software in violation of the Export Administration Act and the Export Administration Regulations maintained by the Department of Commerce.  Illegal material includes, but is not limited to, fraudulent material, copyright infringement,

• Pornographic sites are not permitted.  The designation of pornographic material is left to our discretion.  Sites do not need to be “obscene” or “hardcore” to be deemed pornographic.

• Harmful sites are not permitted.  This includes sites teaching or promoting hate, “warez”, hacking, pirated software, viruses, Trojan horses, or worms.  Security violations such as falsification of origin and intentional interference or interception are deemed harmful.  Other harmful behavior includes, but is not limited to, misrepresentation, fraudulent conduct, and engaging in the collecting of personal information for illegal purposes.

• "Unsolicited Commercial Email,” solicitations and “Spam” is not permitted.  PJLHosting.com reserves the right to determine when a violation has occurred.  Mailing lists should be run carefully, sent to those who knowingly request being on the list.  The option of un-subscribing should be readily available.  Unsolicited postings of your URL in newsgroups is not permitted.

Domain Registration
You are responsible for your own domain name registration.  If we register a domain name for you, we provide this service as a convenience to you and you waive any claims against damages, losses, or expenses due to the registration of your domain by us.  Although we may originally register your domain with our contact information, we can list your contact information for your domain's "whois" information at your request.  At any time, you may use another registrar and transfer the domain we registered for you to a registrar of your own choosing.  Please email us to give us notification of your plans and we will accept the transfer when the confirmation email arrives.

You warrant that the domain name we register for you does not violate the rights of any third party.  You agree to hold PJLHosting.com harmless with respect to claims of third parties concerning your use of such a domain name on the Internet.  In the event of a proceeding, you agree to inform us of the proceedings, such as disputes under the Uniform Domain Name Dispute Resolution Policy, instituted by any party challenging your rights to use any Domain Name hosted by PJLHosting.com servers.  If you lose the proceedings, you agree to immediately inform us of the identity of the party to whom your domain rights are to be transferred.

PJLHosting.com may suspend your services in the event that your rights to a Domain Name are challenged.  We may take further action as required under the Uniform Domain Name Dispute Resolution Policy.  In such a case, we will do our best to prevent loss of your data.

Billing and Cancellations
We reserve the right to deny services when payment is not received.  Checks may be processed before actual activation of services.  Accounts closed due to inappropriate use are not subject to refund.  User cancellation of a service will stop the renewal of services upon the next billing period.

Technical support is offered by email.  Our email address is support@PJLHosting.com.  Phone and live chat is discouraged.

Choice of Law
This agreement is governed by the law of the state of Colorado.

Limitations of Liability
PJLHOSTING.COM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.  WE MAKE NO WARRANTY THAT WE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

YOU AGREE THAT PJLHOSTING.COM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.  THIS INCLUDES LOSS OF PROFITS, GOODWILL, DATA, OR INTANGIBLE LOSSES.  YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO USE OF THE SERVICE OR THESE TERMS OF SERVICE MUST BE FILED WITHIN 14 MONTHS AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.

Agreement to Solve Disputes Through Mediation/Arbitration
The parties to this agreement are Christians and believe that the Bible commands them to make every effort to live at peace and to resolve disputes with each other in private or within the Christian church (see Matthew 18:15-20; 1 Corinthians 6:1-8). Therefore, the parties agree that any claim or dispute arising from or related to this agreement shall be settled by biblically-based mediation and, if necessary, legally binding arbitration in accordance with the Rules of Procedure for Christian Conciliation of the Institute for Christian Conciliation, a division of Peacemaker^® Ministries (complete text of the Rules is available at www.Peacemaker.net). Judgment upon an arbitration decision may be entered in any court otherwise having jurisdiction. The parties understand that these methods shall be the sole remedy for any controversy or claim arising out of this agreement and expressly waive their right to file a lawsuit in any civil court against one another for such disputes, except to enforce an arbitration decision.
